Warranty.
Planar(PlanarSystems,Inc. or PlanarInternational Ltd.) warrantsthat, upon
delivery, the goods sold hereunderwill be free of defectsin materialsand
workmanship, andsuchgoodswill substantiallyconform to the specifications
furnished by Planar,and to any drawingsor specificationsfurnished to Planarby
the Buyer if approvedby Planar.This warranty shall be effective only if Planar
receivesnotice of suchdefector nonconformanceduring the period of the
warranty. Planar'ssole and exclusiveliability for breachof warranty shall be, at
Planar'soption, to repair or replacethe Planarproduct(s) with refurbished units or
provide a credit to buyer in the amount of the purchaseprice.
a. Commencement of Warranty .
The warranty period beginson the dateof delivery.
b. Duration ofWarranty.
The goods sold hereunder arewarranted for a period of one year unless
otherwise agreedto by Buyer and Planar.
c. Place of Repair or Replacement.
Buyer mustreturn the defectiveor nonconforming goods,upon request,to
Planarnot later than 30 daysafterPlanar'sreceipt of notice of the alleged
defector nonconformance.Buyer shall prepay transportationcharges.Planar
shallpay for the return of the goods to Buyerby surfacetransportation. No
goodsareto be returned to Planarwithout prior authorization.
d limitation of Warranty.
The foregoing warranty shall not apply to defectsresultingfrom (a) improper
or inadequatemaintenanceby Buyer; (b) unauthorizedmodification of the
goods;(c) operation of the goods outsideof the environmentalspecifications
(d) neglect,misuseor abuseof the goods;or (e) modification or integration
with other goodsnot coveredby Planar'swarranty when such modification or
integration increasesthe likelihood of damageto the goods.
e. Technical Assistance.
The warranty set forth aboveshall not be enlarged,diminished or affectedby,
and no obligation or liability shall arisefrom Planar,any authorized dealer or
any other person'srendering of technical advice,assistanceor servicesin
connectionwith Buyer'sorder of the goodsfurnished hereunder. The Buyer
is not relying on Planar'sskill or judgementto selector furnish suitablegoods.
f. Installation.
Planarmakesno warranty with respectto any installation of Planar's
product(s) by Planar,any authorized dealer,or any other person.
g. Customer Support.
